ELIGIBILITY

Contests are open only to new and existing WinSportingGoods.com users who are residents of the 50 United States and the District of Columbia, 18 years of age or older at the time of entry. Employees and their immediate family members (parents, husband, wife, brothers, sisters and children) of WinSportingGoods.com and the Sponsor, their agents, affiliates, businesses and subsidiaries of each are not eligible to win. Residents of Florida and New York are not eligible to participate in a contest with a total prize value of $5,000 or more unless otherwise indicated.

CONTEST PERIOD

Contests typically run for a 30-day period, but no longer than 180 days. Contests will begin and end upon the dates listed within each contest's “pop-up window” (accessed by clicking on the contest picture within any contest box), provided there has been a minimum of 500 entrants per contest. In the event there are not at least 500 entrants for a given contest within the original contest period, the contest period may (at the discretion of WinSportingGoods.com) be extended by additional 30 day increments until such time as there are 500 entrants, or that the contest has run for 180 days in total, whichever comes first.

ENTER ONLINE OR BY MAIL

Enter on-line. You may enter each contest one time, but can enter as many contests as you wish. Each contest description has a different start and completion date. To be eligible, entries may be made beginning at 12:00:01 AM ET on the beginning date and received by 11:59:59 PM ET on the applicable completion date (i.e., then conclusion of the applicable contest period).

Access the WinSportingGoods.com web site at http://www.WinSportingGoods.com and follow the instructions to enter each contest you wish to participate in. All information required must be provided. In order for an entry to be valid, participants must click the “submit” button. Entries specifying an invalid or inactive email address will be disqualified and ineligible to win. Entries must be submitted by an authorized email account holder. In the event of a dispute regarding the identity of the person submitting an e-mail entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered.

Enter by mail. You may also enter by regular United States mail. Hand print your complete name, street address, city, state and zip, age and email address and the specific contest(s) you are entering, on a 3x5 card and mail to:

Mail entries must be postmarked by the applicable completion date and received no later than the seventh date following the completion date. Each entry must be mailed separately.

All Entries. In the event multiple entries per contest are submitted by a participant in good faith, only the first received will be eligible; the additional entries will be voided and disregarded. All entries become the property of the Sponsor and will neither be acknowledged nor returned. Sponsor is not responsible for lost, late, misdirected, postage due, damaged, illegible or incomplete entries, all of which are void. PRIZES

Contest prizes and their respective approximate retail values will be posted within the description of each individual contest. Sponsor may substitute contest prizes described with a prize of equal or greater value. Prizes are not transferable. Winners may not choose cash or alternative prizes unless offered by Sponsor. Taxes (if any) are the responsibility of the winner.

SELECTION OF WINNER

Upon the completion of each contest period and the closing date for mail entries, one (1) winner will be selected by a random drawing from all entries received. Drawing will be conducted by WinSportingGoods.com or its designee. Odds of winning depend upon the number of entries received. Method of entry has no effect on odds of winning.

ANNOUNCEMENT OF WINNERS

Winner(s) will be notified by our standard weekly email sent to all entrants of a given contest, whereby a "winners" URL (Web address) will be shown. All entrants must go to the special URL (Web address) to see if they've won. If the information on the "winners" page matches their information (i.e. email address, phone #, birthday, or combinatoin thereof), they are then prompted to contact us via email (or the contact form on the "winners" page. All winner(s) have 30 days from the contest end date to contact us after being notifed of who the winner(s) is. Winners can contact WinSportingGoods.com by email, contact form, or by phone via our phone # listed on our "contact us" page. Once WinSportingGoods.com is contacted by the individual winner, we will start the prize fulfillment process. All winner(s) will only be contacted at the email address they supplied to WinSportingGoods.com at the time of entry. If a potential winner is found to be ineligible, declines to accept a prize, doesn't contact us within 30 days of notice, or in the event that a prize or prize notification is returned as undeliverable, the prize will be forfeited and not awarded. Sponsor is not responsible for any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in any contest. Sponsor is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions or any mistake in the printing of these rules or failure to make e-mail or regular mail notifications, if any, to participants. • Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of the online entry form will be accepted. Mechanically duplicated, mass machine printed entries, or entries not otherwise in compliance with the Official Rules will be disqualified. Proof of emailing does not constitute proof of delivery.
• If for any reason the Internet entry method is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of WinSportingGoods.com which corrupt or affect the administration, security, fairness, integrity or proper conduct of a contest, WinSportingGoods.com reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest. Should any contest be terminated prior to the stated completion date, notice will be posted on the WinSportingGoods.com web site.
• Winners, by acceptance of a prize, agree to release the Sponsor, its parent, subsidiary and affiliated businesses and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives and any other person or entity associated with the contest from any and all liability claims or actions of any kind whatsoever for injuries, damage or losses to persons and property which may be sustained in connection with the receipt, enjoyment, ownership or use of the prize. The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of any prize awarded.
• If due to mistake or other error, more prizes are claimed than intended to be awarded according to the "Prizes" section of the contest description and of the Official Rules, such prize(s) will be awarded in a random drawing from among all such excess prize claims received. In no event will Sponsor be liable for more than the number of prizes stated in the "Prizes" section of the Official Rules.
• Each promotion is governed by the laws of the United States. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of a participant and Sponsor in connection with a contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Florida. Each participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with a contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) if the parties are unable to resolve their dispute amicably, it shall be resolved exclusively in a federal or state court within the State of Florida; (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contests, but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
